Who may share the blame

The driver may have been speeding, tired, distracted, or turning unsafely. The carrier may have pushed tight schedules or skipped maintenance. A separate company may own the trailer, or a shipper may have loaded it badly. Each of these may carry its own insurance, and finding all of them matters when injuries are serious.

Delivery vans and rental trucks

Not every truck crash involves a semi. Delivery vans make many stops a day, often under time pressure. Rental trucks are sometimes driven by people with little experience handling a large vehicle. In these cases, the driver’s employer, a delivery contractor, or the rental company’s coverage may apply. We sort out which policies are in play.

Government trucks and shared fault

A city, county, or transit vehicle adds a step: a written claim and a 60-day wait before a lawsuit (RCW 4.96.020). And if the trucking company says you share the blame, Washington still lets you recover the rest (RCW 4.22.005).

Government claims follow their own rules. A claim against the City of Renton goes to the City Clerk’s Claims Office at 1055 South Grady Way, by email or through the city’s online portal. The city takes up to 60 days to review it. State law requires that 60-day wait before a lawsuit against a local government (RCW 4.96.020).

Court and deadlines

King County Superior Court splits the county into two case areas. An injury case goes to the area where the injury happened, and Renton, south of I-90, is in the Kent case area (LCR 82). So a Renton case is usually heard at the Maleng Regional Justice Center in Kent, not in downtown Seattle.
